Houses of Asia acts as an agent for the property owner of accommodation featured on our website. Your contract is with the property owner. This contract incorporates all the conditions below. Houses of Asia is not a management company.
The paying of the deposit confirms the acceptance of the terms and conditions set out below and shall be binding on the persons intending to occupy the premises whether or not such persons have signed the booking form.
Rates are quoted as a daily rate. Rates for each villa reflect the maximum occupancy. Rates are for 2012 and are occasionally, if rarely, subject to changes without prior notice. Your rental comes with the facilities listed on the relevant web page.
Included in the price are normal use of water, gas, electricity, housekeeping services of the villa (including clean sheets and towels), and swim pool maintenance.
Not included in the price is excessive use of electricity, use of internet, telephone costs, Pick-up service: to and from the airport etc.
The deposit of 30% of the villa rental is payable within the 10 days of the option period. The full balance is payable no later than 42 day prior to the date of arrival. If the booking is within 42 days of the arrival, the whole cost of the Villa rental shall be due at the time of booking. If Houses of Asia does not receive the balance by the due date, Houses of Asia reserves the right to cancel the booking and cancellation charges will apply.
Once you have paid your balance a booking confirmation voucher will be issued. You should bring this voucher when checking in at the villa. Your booking voucher confirms which villa you booked, for how long and what facilities will be included in the rental fee. Please study this voucher once you receive it to check that all the details are correct. If you have any questions please contact our reservations department.
Guests should assume the Check-in time is after 15 noon, and checkout time is prior to 11 noon, unless otherwise agreed. Account will be taken where possible of flight arrival/departure times etc.
On arrival guests will be asked for their passports or identity cards, so that the owner can register guests in accordance with regulations.
The capacity of each property has been decided by the owner according to the size of the villa and facilities at the property. The maximum number of guests is stated on each web page, if you are unsure for any reason, please check on booking. We would ask customers to state clearly when booking the final number of all guests who will be arriving. If the number of guests exceeds the maximum capacity, this has to be agreed on booking and any changes have to be advised prior to arrival. We reserve the right to refuse extra guests if the number exceeds the maximum capacity of any given property after a booking has been made. No additional guests may be added after booking unless we have been advised in advance and have agreed it with the owner. If extra guests arrive at the property on or after the arrival date unexpectedly, the owner is within his rights to turn the guests away or make an additional charge. Tents, camper vans or any other form of camping are strictly forbidden at any of the properties.
The cancellation fees are as follows:
cancellation up to the 42nd day (exclusive) before the day of arrival: the deposit.
cancellation from the 42nd day (inclusive) up to the 28th day (exclusive) before the day of arrival: 60% of the villa rental;
cancellation from the 28th day (inclusive) up to the day of arrival: 90% of the villa rental;
cancellation on the day of arrival or later: the full villa rental
Though it is unlikely that Houses of Asia will have to make any changes to confirmed arrangements, it does occasionally happen, and we will advise you at the earliest possible date. If, for any reason beyond our control, we are unable to provide you with the Villa, Houses of Asia shall reserve the right to cancel the reservation. For example, but not inclusive, if the property is damaged or rendered unusable Houses of Asia will endeavor to locate an alternative property for the period required but no guarantee is given that this can be done. However, if this is not possible, or you do not wish to be transferred, Houses of Asia will cancel the booking and refund in full, less any bank transfer charges, the amount paid to Houses of Asia. Houses of Asia shall not be liable for any further obligations or claims by the client.
Houses of Asia recommends a comprehensive travel insurance (
including cancellation, flight delays, loss and damage to baggage and other property) and health insurance (including evacuation and repatriation coverage). Houses of Asia is held harmless by you and your party against all claims including any accidents related to the use of the Villa facilities or locally procured third party services such as, but not limited to, watercraft, water sports, jeep or motorbike rental.
Houses of Asia shall not be responsible for any delay, additional expense or inconvenience caused directly or indirectly by events outside Houses of Asia control such as civil disturbances, fires, floods, severe weather, Acts of God, acts of Government etc.
By acceptance of this contract it is assumed by Houses of Asia that this requirement has and will be complied with in full.
Houses of Asia does not accept responsibility for the breakdown of the supply of water, or electricity, or of swimming pool filtration systems, though we will use our best endeavors to arrange for any such problems to be solved quickly. If there are any problems during the rental period, which could not be solved by dealing directly with the Villa staff please contact the manager immediately and he will use its best endeavors to rectify the situation. It is understood that infrastructure, local standards and conditions are often of a less developed nature in a remote resort location than in most urban environments Houses of Asia will do as much as can be reasonably expected to avoid and rectify any problems that may occur, but cannot be held responsible for any problems. Any complaints must be notified to Houses of Asia manager within 24 hours of the occurrence-giving rise to the complaint. Should a problem remain unsolved please make a complaint in writing to Houses of Asia within 14 days of the completion of the rental period. If the Villa is vacated before the end of the rental period without mutual agreement, this may result in the loss of all rights to compensation.
The person signing the contract is responsible for the correct and appropriate behavior of the guests staying at the Villa. Should any member of the party not behave in such a manner, Houses of Asia's local representative may at their absolute discretion ask the offending guest or guests to vacate the Villa forthwith.
The services of staff are included at the villa. Additional services such as those of cooks and/or drivers can be booked extra with the booking.
The owner should be advised of any breakages immediately. Please do not take away any items from the property at the end of your stay, they do not belong to you. Any items missing will be considered as theft. Please treat your accommodation / owners / fixtures and fittings with respect. Any illicit damage will be charged for. If guest's behaviour is found to be unacceptable, owners have the right to terminate the rental immediatley, no refund will be due. Guests are kindly asked to abide by any rules and regulations set out by the property. Rules and regulations are set out for everyone and help with the management and running of a property. Please kindly abide by them and please be considerate of others.
We believe we have represented all the properties that appear on the web site accurately. The properties available for rent are not graded in the conventional way. However, they are all of a high standard of cleanliness, comfort and furnishing. Some details may be different from other countries but are in keeping with local traditions (e.g.: hard floors) However, we cannot be held responsible for any changes made by the owner since our last visit and which we are not aware of.
Some of the properties are in the heart of the countryside and/or working farms. Therefore, there may be some farm animals (chickens, horses) and owner's pets. If this is problematic just ask before booking.
All of our villas are self catering accommodation. In general, items such as toilet rolls, cleaning items, detergents, etc. are not included in the rental price (unless otherwise stated). A few property owners do include starter pack / amounts of basic items. However, this is entirely at the discretion of each individual owner.
In order to complete your booking we require some personal details from you. We will only use this information in order to complete your booking and undertake to keep personal details confidential.
Any valuables left at the property are left at one's own risk. Neither Houses of Asia nor the owners nor the staff is responsible for their loss or damage.
All passports, visas and health certificate requirements are the clients' responsibility. The owners and their agents accept no responsibility for any delay or expense incurred through any irregularity in such documents.
As part of this agreement Guests are required to take due care when residing at the villa and especially children playing in the gardens; near the entrance from the main road; near or in the pool, on the beach, including the sea. Furthermore Guests are reminded not to enter the Villa wet, as the floors can be slippery. Injury, damage or injury arising shall not be the responsibility of Houses of Asia in any way whatsoever.
